A. SCHEMATIC DESIGN PHASE

1. Zoning and Code Research 

i.  Any variance, critical area, plot issue, historic preservation, etc., work required will be extra (NOT IN CONTRACT) and will be billed at hour rates.

2.  Partial Field Verification and Partial Existing Drawings will be extra (NOT IN CONTRACT) and billed at our hourly rates, the total not to exceed $500.00 dollars.  See hourly billing rates under Compensation Arrangements.  

3. Develop Design Program to meet client's desires.

4. Sketches Of Conceptual Design in the following drawings:

i.   Site and Floor Plans
ii.  Interior Elevations and Sections, as required
iii. Exterior Elevations, as required
iv. Detailed Perspective Drawings, as required

5. Develop Preliminary Construction Budget

WRITTEN APPROVAL IS REQUIRED TO MOVE TO THE NEXT PHASE


B. DESIGN DEVELOPMENT PHASE

1.  Drafting of final conceptual design in the following drawings as required:

i.    Floor Plans and Reflected Ceiling Plans
ii.   Exterior Elevations
iii.  Interior Elevations
iv.  Construction Details
 v.  Power and Telephone Location Plan
vi.  Millwork Drawings
vii. Site Plan

2. Develop Electrical and Plumbing Fixture Plans and Schedules.

3. Coordinate Any Engineers Required For The Project.

4. Revise Preliminary Construction Budget.

WRITTEN APPROVAL IS REQUIRED TO MOVE TO THE NEXT PHASE


C. CONSTRUCTION DOCUMENTS PHASE


1. Demension all drawings
2. Detail necessary construction methods
3. Provide construction specifications
4. Provide construction material schedule
5. Provide product specifications
6. Coordinate construction notes
7. Revise preliminary construction budgets


D. CONSTRUCTION PHASE


1. Conduct bid for project

i.   Prepare documents for sub-contractors list
ii.  Issue drawings to bidding sub-contractors list
iii. Answer sub-contractors bid questions
iv. Receive bids
 v. Notify selected sub-contractors

2. Permit service is an extra (NOT IN CONTRACT) and will be provided to the owner at an hour rate, not to exceed $500.00 per day.

3. Construction Administration

i.   Consult on construction contract
ii.  Coordinate and clarify material orders with sub-contractors, if required
iii. Approve construction payments
iv. Review construction progress
 v. Coordinate any changes in scope of work during construction  with owner and sub contractors
vi. Coordinate final walk-through and paperwork to close out the project


E. PROMOTIONAL RELEASE

1. Home owner  agrees to allow P.L. Johnson Construction, Inc., to photograph all work, both in progress and completed.  These photographs will be used for record keeping and marketing purposes, includng but not limited to, brochures, magazine articles and P.L. Johnson Construction, Inc. Web pages.

2. Home owner agrees to allow P.L. Johnson Construction, Inc., to place a sign in the front yard of the job site in jurisdictions where signs are permissible by law.  The sign will be no larger than 30" tall by 24" wide.


F. COMPENSATION ARRANGEMENTS

1. Design Services: P. L. Johnson Construction, Inc., will receive a fee for our services in the amount listed below.  Note: We will use appropriate level designer required.

i.   PRINCIPAL or REGISTERED ARCHITECT:  $125.00 per hour - minimum 4 years education, with 5 years work experience, or minimum of 10 years work experience.

ii.  SENIOR DESIGNER:  $75.00 per hour - minimum 4 years of education,  with 3 years of work experience, or minimum of 10 years work experience.

iii. JUNIOR DESIGNER:  $45.00 per hour - minimum 2 years of education, with 1 year of work experience, or minimum of 5 years of work experience.

iv. ENTRY DESIGNER:  $30.00 per hour - minimum 4 semesters of education, or 1 year work experience.

 v. SUPPORT STAFF:   $25.00 per hour - Secretarial and Accounting Services.


2. Disbursements: Home owner agrees to reimburse P.L. Johnson Construction, Inc. for any out-of-pocket expenditures incurred by P.L. Johnson Construction, Inc. in order to perform our obligation under this agreement, including, but not limited to:

i. Blueprints ($3.00 per sheet), photocopies ($.50 per sheet), long distance calls, postage, consultant fees (e.g., structural, mechanical, electrical and civil engineers), permits, parking, mileage ($.30 per mile), etc.

3. Payment:  Payment is due upon receipt of invoice.  Any payment not received within ten (10) days of the date of invoice will be considered deliquent. All Design Services will cease until payment of past due amount is made in full.

Each payment, when rendered, will be non-refundable.  If you desire to terminate our services, all hourly services up to date of termination will be billable and will be considered as services rendered.  All billable time, including disbursements, will not be refundable.

Homeowner may terminate this agreement at any time with written notice to P.L. Johnson Construction, Inc. 

Assuming P.L. Johnson Construction, Inc. or any P.L. Johnson Construction, Inc. sub-contractor has faithfully and diligently performed its obligations in a workmanlike manner according to the terms and conditions of this contract, including any addendums or modifications, if the owner fails to pay any amount due according to the terms as set forth herein, the owner agrees to pay all costs and expenses incurred by P.L. Johnson Construction, Inc. or any P.L. Johnson Construction, Inc. sub-contractor in collection of the amount due, including all attorneys' fees, based on an hourly rate of $250.00 per hour.  Any delinquent amounts due from the owner to P.L. Johnson Construction, Inc. or any P.L. Johnson Construction, Inc. sub-contractor will bear interest at the rate of one and one-half percent per month (18% APR).  We will apply any sums paid by the owner first to any outstanding interest and the remainder to the principal sum due under this contract.

4. Fee Cap and Limitations:  Our design fee for your project will not exceed dollar amount except for extras (NOT IN CONTRACT) and any changes made by client after approval, or other reasons beyond our control.  Disbursements are not inclusive of this fee cap.

Upon approval of our proposal, we would appreciate your signing the enclosed copies and submitting a Retainer payment of (Dollar Amount) with the signed agreement.
